By using BLIP's Internet Services and the services (collectively, the "Services") provided by BLIP, its partners and associates (collectively, "BLIP"), you agree to the following terms of this Acceptable Use Policy, including the terms contained in the General Provisions below:
This Acceptable Use Policy (AUP) constitutes the agreement between BLIP ("BLIP" or "our") and the customer ("you" or" your") subscribing to the Services. This Acceptable Use Policy governs your use of the Services and any devices and/or equipment used to support the Services, including without limitation, connectivity devices and software used in conjunction with the Services which is loaned to you from BLIP for your use solely in connection with the Services (collectively, the "Equipment"). By activating the Services, you acknowledge that you have read, understand and agree to this Acceptable Use Policy as set out hereunder and with terms and conditions of BLIP's Terms of Services (collectively, the "Agreement"). If you do not wish to be bound by this Agreement or any modifications, which may be made by BLIP from time to time (as described in the following paragraph), discontinue use the Services and immediately contact BLIP.
BLIP may revise this Agreement and provide notice of such material changes to you by sending you an electronic mail message at your account record's official email address. Such changes shall be deemed effective upon the electronic communication being retrievable by you. YOU ARE RESPONSIBLE FOR REGULARLY REVIEWING INFORMATION SENT TO YOU AND POSTED ONLINE TO OBTAIN TIMELY NOTICE OF SUCH CHANGES. YOUR NON-TERMINATION OR CONTINUED USE OF THE SERVICES AFTER YOU ARE NOTIFIED OF CHANGES CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AS MODIFIED BY SUCH CHANGES. If you do not agree with any of the amendments to this agreement, you agree to stop using the Services and to provide notice to BLIP of your termination of this Agreement in accordance with the terms of the Terms of Service. BLIP customers should consult this document regularly to ensure that their usage conforms to the most recent version. In the event of conflict between any customer agreement and this Agreement, the terms of this Agreement will govern. BLIP provides a variety of Internet and Network Services to residences and businesses. BLIP High Speed Internet Services allow residential and commercial customers to connect to the BLIP Network backbone, and out to the Internet.
The Services use infrastructure and resources that are shared with many customers. The benefits and privileges available from the Services, and the Internet in general, must be balanced with duties and responsibilities designed to guarantee uniform access to all customers of the Services.
Use of the Services is subject to the following rules and guidelines. You are responsible for ensuring that the use of all Services provided to you comply with this Agreement.SecurityLast updated: October 17, 2014
You are responsible for any misuse of the Services that originate from your account, even activities committed by any friend, family, co-worker, employee, guest or anyone with access to the account. You must ensure that others not gain unauthorized access to the Services.
The Services may not be used to breach the security of another user, or to attempt access to anyone's computer, software or data, without the knowledge and consent of that person. The Services may not be used in any attempt to circumvent the user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, probing the security of other networks. Use or distribution of tools designed for compromising security, such as password guessing programs, cracking tools, packet sniffers or network probing tools is strictly prohibited.
YOU MAY NOT DISRUPT THE SERVICES or use The Services to interfere with computer networking or telecommunications services to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abuse of operator privileges and attempts to crash a host. The transmission or dissemination of any information or software which contains a virus or other harmful feature is also strictly prohibited.
YOU ARE RESPONSIBLE FOR THE SECURITY OF ANY DEVICE YOU CONNECT TO THE SERVICES, INCLUDING, WITHOUT LIMITATION, DATA STORED ON THAT DEVICE. In particular, BLIP recommends against enabling file or printer sharing of any kind. BLIP recommends that any files or services you make available for remote access be password protected.
Illegal ActivityLast updated: October 17, 2014
Use of the Services for any activity that violates Local, State, Federal or International law, order or regulation, is a violation of this Agreement. Prohibited activities include, but are not limited to:
Posting, storing, transmitting or disseminating unlawful material, including without limitation, child or other pornography, any content, data or other material which is libelous, obscene, hateful, unlawful, threatening, reaction or ethnically offensive, defamatory or which in any way constitute or encourages conduct that would constitute a criminal offense.Disseminating material which violates copyright or intellectual property rights. The customer assumes all risk regarding whether material is in the public domain;
Pyramid or other illegal soliciting schemes; orFraudulent activities; including but not limited to: impersonating any person or entity, or forging anyone's digital or manual signature.Federal law provides severe civil and criminal penalties for the unauthorized reproduction, distribution or exhibition of copyrighted motion pictures and certain programming and BLIP shall not be liable for the same, nor is BLIP granting you any rights in that regard whatsoever.
Inappropriate ContentLast updated: October 17, 2014BLIP is not responsible for any content you post, store, transmit, disseminate or access through use of the Services. Any content questions or complaints you may have regarding content you access should be addressed to the content provider. You are responsible for information published to the Web or other Internet services, through your account.
BLIP has no obligation to monitor transmissions made on the Services. However, BLIP has the right to monitor such transmissions and to disclose the same in accordance with BLIP's Privacy Policy. By using the Services to access, publish, transmit or distribute content, a user is warranting that the content complies with this Agreement.
Electronic MailLast updated: October 17, 2014
BLIP is not responsible for the forwarding of email sent to any account which has been suspended or terminated. Such email will either be returned to sender, ignored, deleted, or stored temporarily, at BLIP's sole discretion.
BLIP limits the number of email messages that you can send through the Services using BLIP's email servers. The Services may not be used to send unsolicited bulk or commercial messages. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures and political or religious messages. Such messages may be sent only to those who have explicitly requested them.
The Services may not be used to collect responses from unsolicited email sent from accounts on other Internet hosts or email services which violates this Agreement or the acceptable use policy of any other Internet service provider.
Internet Relay Chat and Messaging SystemsLast updated: October 17, 2014
The Services may be used to participate in Chat discussions hosted by BLIP servers, third party servers, or may not involve servers at all. In all cases, BLIP does not monitor the contents of the discussion and is not liable for the content of any communications made via Internet Chat.
The Services may not be used for malicious automated programs, such as bots or clones, chat flooding.
The Services may not be used to send messages which disrupt another Internet user's equipment, including software, hardware and user display. The Services may not be used to access any chat server in violation of this Agreement. The Services may not be used to manipulate any chat server in order to harass or disconnect other Internet users, or to gain privileges which have not been authorized. You are not permitted to use the Services to connect to chat servers or channels from which you have been banned. The Services may not be used to continue to send chat messages to an Internet user who has indicated their desire to not receive messages.
Prohibited ActivitiesLast updated: October 17, 2014UNDER NO CIRCUMSTANCES WHATSOEVER ARE YOU PERMITTED TO RESELL, SHARE, OR OTHERWISE DISTRIBUTE THE SERVICES OR ANY PORTION THEREOF TO ANY THIRD PARTY WITHOUT THE WRITTEN CONSENT OF BLIP AND PAYMENT OF APPLICABLE FEES. For example, you cannot provide Internet access to others through a wireless or dialup connection, host shell accounts over the Internet, provide email or news service, or send a news feed unless express permission is granted by the customer agreement. You may not run provide network services to others via the BLIP Services.
You must ensure that your activities do not improperly restrict, disrupt, inhibit, degrade or impede BLIP's ability to deliver and monitor the Services, backbone, network nodes and/or other network services.
Traffic Management PoliciesLast updated: October 17, 2014
BLIP uses traffic management policies to ensure proportional access to its network for all BLIP Internet customers. Standard network expansion and upgrade activities are undertaken to increase the bandwidth availability for all users.
The traffic management policies implemented by BLIP may use IP addresses to make real-time traffic management decisions in relation to BLIP's network. Since IP addresses have the potential to be linked to an individual's customer account, IP addresses could be considered personal information, however the traffic management policies implemented by BLIP do not involve capturing, storing or archiving this information in any way.
Violation of this AgreementLast updated: October 17, 2014
BLIP does not routinely monitor the activity of accounts for violation of this Agreement. However, in our efforts to promote good citizenship within the Internet community, BLIP will respond appropriately if it becomes aware of inappropriate use of the Services. Although BLIP has no obligation to monitor the Services and/or the network, BLIP reserves the right to monitor bandwidth, usage and content from time to time, to identify violations of this Agreement; and/or to protect the network and BLIP Internet customers.
BLIP prefers to advise customers of inappropriate behavior and any necessary corrective action. However, if you use the Services in a way which BLIP, in its sole discretion, believes violate this Agreement, BLIP may take any responsive actions they deem appropriate. Such actions include, but are not limited to, temporary or permanent removal of content, filtering of Internet transmissions, and the immediate suspension or termination of all or any portion of the Services. BLIP will not have any liability for any such responsive actions. The above described actions are not BLIP's exclusive remedies and BLIP may take any other legal or technical action it deems appropriate.
BLIP reserves the right to investigate suspected violations of this Agreement, including the gathering of information from you or other users involved and the complaining party, if any, and examination of material on BLIP's servers and network. During an investigation, BLIP may suspend the account or accounts involved and/or remove material which potentially violates this Agreement.
You hereby authorize BLIP to cooperate with (i) law enforcement authorities in the investigation of suspected criminal violations, and/or (ii) system administrators at other Internet service providers or other network or computing facilities in order to enforce this Agreement. Such cooperation may include BLIP providing the username, IP address, or other identifying information about a subscriber, in accordance with the guidelines set out in BLIP's Privacy Policy.
Upon termination of your account, BLIP is authorized to delete any files, programs, data and email messages associated with such account.
The failure of BLIP to enforce this Agreement, for whatever reason, shall not be construed as a waiver of any right to do so at any time.
You agree that, if any portion of this Agreement is held invalid or unenforceable, that portion will be construed consistent with applicable laws as nearly as possible, and the remaining portions will remain in full force and effect.
General Provisions Last updated: October 17, 2014Customer Computer It is your responsibility to ensure that your computer equipment meets minimum requirements and performance standards to connect to BLIP Services.
Relocating BLIP Network Equipment You agree not to relocate BLIP's Router and Radio Transceiver within your premises without notifying BLIP, so that BLIP may schedule a mutually agreeable time to undertake such work.
Ownership of Addresses BLIP owns all addresses provided to you, including but not limited to IP addresses, e-mail addresses and personal Web page addresses. BLIP MAY MODIFY OR CHANGE SUCH ADDRESSES AT ANY POINT IN TIME AND SHALL IN NO WAY BE REQUIRED TO COMPENSATE YOU FOR SUCH CHANGES.Multiple Users You acknowledge that you are executing this Agreement on behalf of all persons who use the Services through your computer. You assume all liability for such use of the Services and are responsible for ensuring that all such other users understand and comply with the terms and conditions of this Agreement.
Intellectual Property of BLIP and Others Nothing within the Services or any additional services offered by BLIP from time to time or through any BLIP Web site shall be construed as conferring any license of BLIP's or any third parties' intellectual property rights, whether by estoppel, implication, waiver, or otherwise. You acknowledge and agree that BLIP's Web sites, Maerials and the Services and/or additional services offered by BLIP from time to time are protected by copyright, trademark, patent, or other proprietary rights.

Any disclosure of customer personal information is governed by and made in accordance with BLIP's Privacy Policy as contained herein;BLIP may disclose any information as is necessary to:
satisfy any legal, regulatory or other governmental requirement or request;obtain, deliver, operate and market the Services properly;protect BLIP or its customers, in accordance with the guidelines set out in BLIP's Acceptable use Policy and/or Privacy Policy.
What type of Personal Information does BLIP collect?
If you wish to obtain any of BLIP's products and/or services, BLIP will collect information about you when you apply for any of these services. The type of information we collect varies based on the service you have requested. The Personal Information most often collected and maintained in a Customer file may include (but is not limited to) name, address for service, mailing address, phone number(s), a piece of acceptable identification, alternate contact information, banking information for payment, non-BLIP email address (for instance if you are an eBill user), credit card information for payment, and credit rating/score. In order to conduct credit checks, we may collect one or more of the following: driver's license number, Social Security Number, credit card number and/or date of birth. If we need to know about your credit history we may also receive information from third parties.
Why does BLIP collect Personal Information?BLIP collects Customer's Personal Information for the following purposes, to:
establish and maintain a responsible commercial relationship with you;understand your needs as a Customer and your eligibility for products and services;recommend particular products, services and opportunities to its Customers;provide information to you about developments and new products;develop, enhance and market products and service and/or provide products and services to its Customers;process billing and collection of the fees for the BLIP products and services you have purchased and/or subscribed to;perform or order credit checks;deliver its products and/or services to its Customers; andmeet BLIP's legal and regulatory requirements.
Your role in protecting your Personal Information:
Please remember that BLIP's Privacy Policy and our use of your Personal Information only applies to the information you provide and we caution that if you disclose Personal Information or personally sensitive data through use of the Internet such as through chat rooms, communities, bulletin boards or other public online forums, this information is not collected by or for BLIP but may be collected and used by other persons or companies over which BLIP has no control. It is your responsibility to review the privacy statements of any person or company to whom you choose to link, from or through the use of any BLIP Internet services. BLIP is not responsible for privacy statements or compliance or other content of any website not owned or managed by BLIP or BLIP's group of companies.
BLIP does its' best to protect and safeguard Personal Information and we believe there are measures you should take as well. Do not share your Personal Information such as bank card numbers, credit card numbers, associated pin numbers or Social Insurance numbers with others unless you clearly understand the purpose of their request and you know with whom you are dealing. Do not keep sensitive Personal Information in your email inbox or on Webmail. Provide BLIP with one acceptable piece of identification that will be kept in your Customer file, so we can identify you when you call us. If you are asked to assign passwords to connect you to your Personal Information, you should use a combination of letters and numbers and do not use words that can be easily associated with you (example: do not use the name of a family member or pet), we also suggest you change your password regularly. If ever you are suspicious of any telephone, mail or email promotional campaigns or you suspect fraudulent activity, please contact us at billing@gotblip.net to verify the campaign is a legitimate BLIP activity.
Updating this Privacy Policy
Any changes to BLIP's Privacy Policy shall be acknowledged in this Policy in a timely manner. BLIP may modify or remove portions of this Privacy Policy when it feels it is necessary and appropriate. You may determine when this Privacy Policy was last updated by referring to the date found at the top right-hand corner of the first page of this Privacy Policy "Privacy Policy last revised on:"

By using any of BLIP's Internet services or any related services (collectively or individually, the "Services") provided by BLIP or their partners and/orassociates (collectively, "BLIP"), you agree to the following terms and conditions of service (the "Terms of Service"):These Terms of Service constitute the understanding between BLIP ("BLIP" or "our") and the customer ("you" or "your") subscribing to all or any of theServices. Radios and optional WiFi Router Equipment is provided for your use by BLIP, in which case the Equipment shall be herein referred to as the"Provider Equipment". By activating and using the Services, you acknowledge that you have read, understand and agree to these Terms of Service asset out below. In addition to the terms contained in these Terms of Service, your utilization of Internet Services is subject to the terms and conditions ofthe BLIP Acceptable Use Policy, available at www.gotblip.net. BLIP recommends that you print a copy of these Terms of Service and the Acceptable UsePolicy.
BLIP may make changes to the Services and offers from time to time. If you do not wish to be bound by these Terms of Service, or any modificationswhich may be made by BLIP from time to time, do not use the Services and immediately contact BLIP. BLIP's Acceptable use Policy (AUP)i. The Services may only be used in accordance with the BLIP's Acceptable Use Policy, available at www.gotblip.netii. BLIP is not required to provide the Services when the Service Location is located outside of BLIP's service area, BLIP would have to incur unusualexpenses to bring the Services to the Service Location, which you do not agree to pay, or when you have failed to make payment of the amountsdue for the Services and/or the Provider Equipment.

BLIP does not warrant the condition or content you are able to access on the Internet through the use of BLIP Internet Services. You acknowledge thatthere may be programming content or other content that you may find offensive and you agree that your viewing and/or use of such content is at your ownrisk. Some programming and/or content may not be suitable for minors and you agree to supervise all minors whom you permit to view content fromInternet through your account with BLIP.
Equipment, Installation, Maintenance and Return ResponsibilitiesLast updated: October 27, 2014
BLIP shall be permitted to install the Provider Equipment in the Service Location. The Provider Equipment is provided solely for your use of the Servicesand will at all times remain the property of BLIP. You will not sell, lease, transfer or assign the Provider Equipment. You may use the Provider Equipmentonly at the Service Location address you have indicated to BLIP at the time you subscribe to the Services. You will not re-arrange, disconnect, remove,tamper, repair or otherwise interfere with the Provider Equipment and any such action may constitute theft of services and/or assets.
i. Charges for Provider Equipment provided by BLIP will be included as part of the monthly Services fee. BLIP may require you to pay a ProviderEquipment deposit prior to providing you with the Provider Equipment. You agree to keep all of the Provider Equipment free and clear of any lienor encumbrance of any kind whatsoever.
ii. You are responsible for the safekeeping of the Provider Equipment. If, while in your care, the Provider Equipment is damaged, lost or stolen youagree to pay BLIP the full cost to repair and/or replace the Provider Equipment, and authorize BLIP to charge your credit card account or yourpreauthorized payment authorization for associated costs.
iii. On the termination of the Services you agree to grant BLIP permission to access the Service Location to remove the Provider Equipment, andagree that BLIP is not required, to alter, repair, replace or re-install wiring, siding, shingles, trim or other facilities.iv. In the event that the Provider Equipment is not recoverable, you hereby authorize BLIP to charge your credit card account or your preauthorizedpayment authorization, in payment for the replacement cost of the Provider Equipment. To arrange return of Provider Equipment contact BLIP'scustomer service by phone at 877-711-2547.
v. All End User Equipment and Devices required for access and use of the Services such as telephones, home security, medical, automation, faxmachines, computer equipment or any other equipment and/or associated devices (collectively, "Your Equipment") shall be and remain yourresponsibility. You agree that BLIP is not responsible for any installation, damage, maintenance, support or loss to Your Equipment arising fromyour use of the Services.
Service Interruption / BLIP's Right of EntryLast updated: October 27, 2014
i. Except when defined in an Individual Service Level Agreement, BLIP and/or its agents may interrupt and/or inspect the Provider Equipment and/orthe Services at any time for any duration of time, without notice or liability to you in order to install, inspect, repair, replace or perform necessarymaintenance on the Provider Equipment, its facilities and/or network, or for other technical reasons as may be required.
ii. You agree to provide BLIP access to the Provider Equipment (including reasonable access to the location the Services are provided ("ServiceLocation") as may be reasonably necessary under the circumstances. BLIP is only required to provide you reasonable notice if BLIP needsaccess inside the Service Location. If you are not the owner of the Service Location, it is your responsibility to obtain and maintain access rightsfor provisions of this paragraph.
iii. You understand that the Services do not function in the event of a power failure and regardless of where the power failure arises. In addition, apower failure or disruption may require BLIP to reset or reconfigure the Provider Equipment, its facilities and/or network to reactivate the Services.
IMPORTANT:BLIP does not warrant uninterrupted use of the Services.
Payment Terms and ConditionsLast updated: October 27, 2014
i. BLIP will bill you each month for the services, by sending electronic invoice to your account "Official Email", provided at the time of setup. You maychange the account Official Email by sending notice of the request to Billing@gotblip.net.
ii. You agree to pay BLIP the total charges for use of the Services, including, without limitation: fees applicable to Installation and/or Service Visits;Provider Equipment return charges; processing fees, late fees, and other costs incurred by BLIP, if your account is past due; any applicableregulatory taxes or surcharges for use of the Services. All such fees may be changed from time to time.
iii. You agree to pay all amounts by the date indicated on your invoice, by using any of the payment methods accepted by BLIP. Payments madeafter the statement date on your invoice will be reflected on your next invoice. Unpaid balances 30 days beyond the Invoice date, are subject to a$5 late fee and possible Service suspension.
iv. If your account becomes suspended for non-payment, you agree to pay a re-activation fee of $20.00.
v. You agree to a $25.00 Insufficient Funds Fee if your credit card is denied or if your check is returned due to non-sufficient funds.
vi. Payment of the full amount due will be required before the Services may be restored on suspended accounts. Overdue accounts are subject totermination of the Services by BLIP.
vii. You are responsible to ensure that the billing information you provide BLIP is accurate, and agree to promptly notify BLIP of any changes in yourbilling information.
viii. You are responsible for all costs, including legal fees, collection agency fees, or Court costs incurred by BLIP to collect any amounts owing underthese Terms of Service.
ix. Any promotional discounts applied to your account for your enrollment in Automatic Payments, will be due in full in event that you discontinueautomatic payments.
x. BLIP reserves the right to examine your credit records at any time, whether before or after providing you the Services.
xi. BLIP offers you several options for contacting us regarding inquiries, support and bill payments: You may contact your local BLIP office at thetelephone number(s) shown on your invoice, visit our web sites at www.gotblip.net or email us at billing@gotblip.net
Termination and SuspensionLast updated: December 16, 2019
i. You may terminate the Services for any reason at any time by providing BLIP no less than 30 days advance notice of your desire to terminate.Applicable Service charges continue to apply until the end of the notice period, or such time as the Services are no longer accessible.
ii. You agree that if the Services are terminated for any reason you will: a. Pay BLIP in full any amounts due and outstanding for your use of the Services and return the Provider Equipment to BLIP; andb. Permit BLIP to access the Service Location at a mutually agreed upon time to remove the Provider Equipment.
iii. BLIP may restrict, block, suspend or terminate all or any part of the Services immediately where you:
a. fail to make timely payment on your account for the Services for more than 60 days.
b. become bankrupt or otherwise insolvent;
c. fail to provide BLIP with reasonable entry and access to perform necessary maintenance on the Provider Equipment
d. are in breach of any term or condition of these Terms of Service or of BLIP's Acceptable Use Policy applicable to the Services that you subscribe to
e. use harassing conduct toward BLIP, it's employees or other customer's; harassing conduct may include but is not limited to slanderous statements/claims, offensive jokes, slurs, name-calling, physical assaults or threats, ridicule, insults, offensive pictures, profane language, and more.
iv. BLIP will attempt to notify you using the information shown on your account stating the reason and date scheduled for the suspension or termination.
BLIP's LiabilityLast updated: October 27, 2014
BLIP shall not be liable for:
i. any interruption or unavailability of the Services.
ii. your conduct, acts or omissions;
iii. any event beyond the reasonable control of BLIP including acts of God, inclement weather (including lightning), power failures, labor disputes,riots or civil disputes, war or armed conflict, any law, governmental order, decision or regulation, or order of any court of competent jurisdiction;
iv. any defacement of, or damage to, the Service Location resulting from the attachment of any instruments, apparatus or associated wiring and/orthe Provider Equipment furnished by BLIP, or removal thereof., when such defacement or damage is not wholly caused by BLIP's negligence; and
v. any damages you incur as a result of the operation or failure of Your Equipment used with the Services, including without limitation if any of YourEquipment now or later become incompatible with the Provider Equipment and/or the Services.THESE TERMS OF SERVICE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF ILLINOIS ANDYOU HEREBY CONSENT TO THE EXCLUSIVE JURISDICTION OF THE COURTS IN JACKSON COUNTY, ILLINOIS.
